Terms and Conditions – Skin Moods

1. Company Information

Skin Moods is a skincare brand based in New South Wales, Australia.

By using this site or placing an order, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use this site.


2. Scope and Changes

These Terms govern all use of our website and all purchases made through it. We may update these Terms from time to time; changes take effect once posted with an updated Last Updated 25.10.2025.


3. Orders and Contract Formation

  • Placing an order is an offer to purchase under these Terms.

  • You will receive an order confirmation email acknowledging receipt. A binding contract is formed when we dispatch the goods and send a shipment confirmation.

  • We may refuse or cancel any order prior to dispatch (e.g. suspected fraud, stock error, pricing error).

  • You confirm you are 18+ or have parental/guardian consent.


4. Pricing, GST and Payment

  • Prices are shown in AUD and include GST where applicable.

  • Prices exclude shipping (calculated at checkout) and, if international shipping becomes available, any import duties/taxes.

  • Accepted payment methods: major credit/debit cards and Shop Pay / Apple Pay / PayPal (as shown at checkout).

  • Payment in full is required before dispatch.

  • All prices are subject to change before order confirmation.

  • We may correct pricing errors and cancel/refund orders placed at an incorrect price prior to dispatch.

  • Online payments are processed via secure third-party gateways; we do not store full card details.


5. Product Information & Use (Cosmetic Disclaimer)

  • Products are for external use only.

  • Patch test prior to first use; discontinue if irritation occurs.

  • Results vary by skin type; no universal outcomes are guaranteed.

  • Ingredient lists are shown on packaging and/or product pages.

  • Content on this site is general information, not medical advice. Consult a healthcare professional for specific conditions.


6. Shipping & Delivery

  • Delivery area: Currently within Australia. (If international shipping begins, this section will be updated.)

  • Processing time: 1–2 business days.

  • Estimated delivery after dispatch: NSW 2–4 business days; other states 3–6 business days.

  • Shipping fees are shown at checkout; any free-shipping promotions will be displayed on site.

  • Risk in the goods passes on delivery to your address (or collection by you). Consider selecting signature-required delivery.

  • Please provide an accurate, complete address. Returned/undeliverable parcels may incur re-delivery costs.


7. Returns, Refunds & Consumer Guarantees (ACL)

We comply with the Australian Consumer Law (ACL). Nothing in these Terms excludes your non-excludable rights.

Faulty / Misdescribed / Damaged in transit

  • Contact us at skinmoodsbrand[at]gmail.com within 7 days of receipt with your order number and photos (if applicable).

  • Depending on the issue and ACL, we will arrange a repair, replacement or refund. If confirmed as our error or a product fault, we cover reasonable return postage.

Change-of-Mind

  • For hygiene reasons, opened/used skincare is not returnable.

  • Unopened items in original, resaleable condition may be returned within 14 days of delivery with prior approval; return postage is at your cost and a reasonable restocking fee may apply.

Skin Reactions

  • Reactions can occur with any cosmetic depending on individual sensitivities and are not of themselves a product fault. Please contact us for guidance; where a defect or contamination is established, ACL remedies apply.

Email skinmoodsbrand[at]gmail.com with your order number, reason, and photos if helpful. We will provide instructions and the return address.


8. Intellectual Property

All site content—including text, product names, images, graphics, videos, logos and other materials—is owned by Skin Moods or our licensors and protected by copyright and trademark laws. Except for personal, non-commercial use, no reproduction, distribution, adaptation or derivative use is permitted without our prior written consent.


9. User Reviews & Content (UGC)

By submitting reviews, ratings or other content (“User Content”):

  • You warrant the content is truthful, lawful and based on your experience.

  • You grant Skin Moods a worldwide, non-exclusive, royalty-free, perpetual, sublicensable license to use, reproduce, modify, publish and display your User Content in any media.

  • We may moderate or remove User Content that breaches these Terms, applicable law, contains personal data, or is misleading.


10. Prohibited Conduct

You must not misuse the site, including by attempting unauthorised access, scraping, introducing malware, spamming, infringing IP, posting unlawful/defamatory content, using automated data collection tools (bots or scrapers), or otherwise interfering with the site’s operation.


11. Limitation of Liability & Force Majeure

  • To the extent permitted by law, our liability is limited—at our option—to replacement, repair, or refund of the product’s purchase price in line with ACL remedies.

  • We are not liable for indirect or consequential losses (e.g., loss of profits, data, or opportunity) except where liability cannot be excluded by law.

  • We are not responsible for delays or failures caused by events beyond our reasonable control (force majeure), including carrier delays, outages, or natural events.


12. General

  • No Waiver: Failure to enforce a provision is not a waiver.

  • Severability: If any term is invalid, the remainder remains in force.

  • Assignment: You may not assign your rights without our consent; we may assign our rights subject to law.

  • Notices: We may notify you by email.


13. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of NSW courts.
